This is a summary of the document “Considerations and proposals for an institutional reform of the Ararteko-Ombudsman of the Basque Country” (full document available in Spanish and Basque). In July 2024, the Ararteko submitted a document with considerations for a reform of the institution of the Ararteko to the President of the Basque Parliament, and subsequently to all the political groups represented in that legislative assembly. The purpose of the document is to address different aspects that should be considered in a future reform of the institution aimed at adapting it to our times.
The reform proposal, promoted by the Ararteko themself, finds its legal basis in Law 3/1985, which creates and regulates the institution of the Ararteko, which provides for the possibility of the Ararteko proposing to the Basque Parliament, in a reasoned manner, those modifications deemed necessary. Moreover, the proposal also draws from Venice Principle 25, which encourages states to undertake all necessary constitutional and legislative adjustments to strengthen and develop the Ombudsman Institutions and their capacity, independence and impartiality. Such a proposal intends to meet the requirements of the new European and international laws and standards in the field of human rights and Ombuds institutions. The aim is none other than to consolidate and strengthen the institution of the Ararteko, due to its essential role in the strengthening of democracy, the rule of law, good administration and, ultimately, in the protection and promotion of human rights and fundamental freedoms.

In 2023 there was a new increase in the activity of the Ararteko-Ombudsman of the Basque Country, which reached a total of 13,602 actions, of which around 8,200 correspond to complaints and queries received through the different channels of attention of the Ararteko. This meant a 7%increase compared to the previous year. The growth was particularly noticeable with regard to the number of complaints received, which practically reached 3,900, meaning an increase of almost 37%. Likewise, the Ararteko initiated 26 ex officio proceedings.
In light of this brief quantitative analysis, the Ararteko considers that there is a sustained and progressive trust of Basque citizens in the effectiveness of the intervention of the Ararteko.
